You paid for the content, so you can use it however you like? Usually not. In most creator deals the creator keeps ownership of what they make, and the brand gets permission to use it in specific ways for a specific time. Those permissions are the usage rights, and they are one of the most common sources of disputes after a campaign.
This is general information, not legal advice.
Ownership vs usage
- Ownership (copyright) normally stays with the person who created the content unless a contract transfers it.
- Usage rights (a licence) are permission for the brand to use the content in agreed ways.
Most deals are licences. Full transfer of ownership ("buyout") is possible but rarer and more expensive.
The five things a usage-rights clause should define
- Channels. Where can the content appear? Your organic social accounts, website, email, in-store screens, paid social ads, TV, outdoor?
- Paid or organic. Running content as an ad is usually priced separately from posting it organically.
- Duration. For how long? Common terms are 30 days, 3 months, 6 months or 12 months. "In perpetuity" costs more, if the creator agrees at all.
- Territory. UAE only, GCC, or worldwide?
- Edits. Can you cut, crop, add captions or combine it with other footage?
Partnership ads and whitelisting
Partnership ads (on Meta) and Spark Ads (on TikTok) let a brand run ads through the creator's handle. The ad shows the creator's name, which often performs better than the same video from the brand account. This needs:
- the creator's explicit permission, and access granted in the platform;
- an agreed time period;
- agreement on spending limits and who handles comments.
It is a separate right from using the file in your own ads, so price and agree it separately.
Exclusivity is not usage
Exclusivity, an agreement that the creator won't work with your competitors for a period, is a different term. It limits the creator's income, so it increases the fee. Keep it short and define "competitor" precisely.
How usage rights are priced
There is no universal rate. In practice:
- Organic reposting on your channels is often included in the main fee.
- Paid usage is commonly quoted as an extra fee that rises with duration.
- Perpetual usage or a full buyout is priced well above short-term licences.
The simplest way to avoid surprises is to list the rights you need in the brief and get them included in the quote. Our influencer brief guide includes a rights section.
A checklist before you book
- Which channels, paid and organic?
- How long, starting from when (delivery or first post)?
- Which countries?
- Partnership ads or Spark Ads included?
- Editing allowed?
- Exclusivity: yes or no, which competitors, how long?
- What happens when the term ends?
Agreeing these in writing before production protects both sides. For the rest of the agreement, see our influencer contract checklist.
